Victims of crime have the right to request restitution for monetary losses due to a crime.
How it Works |
---|
· Victims must submit a request for restitution.
· The County Attorney’s Office submits restitution requests to the court.
· Once ordered by the court, the Clerk of Court manages restitution records. |
Collection Responsibility |
---|
· Court: For self-probation or post-supervision cases.
· DOC Probation: For probation cases, Probation Officers must create a payment plan within 90 days.
· DOC Prison: For prison sentences, the IDOC collects restitution by deducting 20% from inmate earnings, deposits, or allowances. Inmates earn between $3–$15 per day depending on their job. Collected funds are sent quarterly to the Clerk of Court in the county where restitution was ordered. |

Restitution may be ordered for some expenses and is paid by the offender. Compensation, however, refers to financial assistance provided by the Attorney General's Office for victims of violent crimes. For more information, please visit the AG’s Crime Victim Compensation link below.
